Action in the Hennepin County District Court brought on behalf of Mary T. Springrose, a minor, by James v. Springrose, her father and natural guardian, for personal injuries allegedly sustained by said minor while a passenger in an automobile owned by defendant Bert L. Willmore and driven by defendant Margaret Willmore; and by said James Springrose on his own behalf for consequential damages. The case was tried before Douglas K. Amdahl, Judge, and a jury, which found in a special verdict that defendant driver was negligent; that the minor plaintiff was not negligent; but that she assumed the risk of being injured. The court denied plaintiffs alternative motion for judgment notwithstanding the verdict or for a new trial, and they appealed from the judgment entered.
