Four actions in the district court for Steele county, consolidated for trial and heard together on appeal, one by Mary Simon for personal injuries arising out of a collision between the car in which she was a passenger driven by Sidney Simon, her husband, and a car driven by Glenn Carroll, defendant; one by said Sidney Simon for personal injuries, property damage, and consequential damages for his wifes injuries against said defendant, wherein defendant counterclaimed; one by Melvin Thorson, who was a passenger in Glenn Carrolls car, for personal injuries against both drivers; and one for wrongful death by Joseph F. Schiller as trustee of the estate of Matilda Schiller, who was a passenger in Sidney Simons car, against both drivers. The cases were tried before Axel B. Anderson, Judge, and a jury, which returned verdicts of $4,650 and $8,495 for Mary and Sidney Simon respectively, $5,500 for Melvin Thorson against Glenn Carroll, and $2,048 for Joseph F. Schiller against Glenn Carroll. Defendant Carroll appealed from an order in each case denying his alternative motion for judgment or a new trial.
